Frequently asked questions about legal stay and work in Poland

1. Does the law office work in all of Poland?

I handle stay and work legalization cases only at the Małopolska Voivodeship Office in Kraków.

2. Can I book an online consultation?

Yes. I offer consultations in Polish and English, both online and in person in Kraków.

3. How long does the legalization process take?

By law, a temporary residence permit should be processed within 60 days after all conditions are done. However, in practice, it usually takes longer based on my experience.

4. Do I have to pay to apply for legal stay and work?

Yes, every application comes with a government fee. The fee is usually between 340 and 640 PLN, depending on the type of application.

5. What documents do I need to apply for a temporary residence permit?

The basic set includes a filled-out application form, a valid passport, photos, and payment receipts. I will prepare a full list of documents just for your situation.

6. Can I work while waiting for the residence and work decision?

Yes, in some cases. If your current legal status allows you to work, you can usually continue working until you get the final decision.

7. What’s the difference between a regular temporary residence and work permit and the EU Blue Card?

The EU Blue Card is for specialists and highly qualified workers. It gives more benefits than a regular permit. With the Blue Card, foreigners can live and work in Poland for up to 3 years.

After 2 years, they can change employers without needing a new permit. A regular permit is available for all types of jobs, but it doesn’t offer the same extra rights and flexibility as the Blue Card.

8. What happens if the office refuses my residence and work permit?

If your application is refused, I will prepare and file an appeal to the Head of the Office for Foreigners. If needed, you also have the right to take the case to the Administrative Court.

9. Can my family join me in Poland?

Yes - if you meet certain conditions under the Foreigners’ Law, you can apply for a family residence permit for your spouse and children who are not living in Poland yet.

10. Can I change my employer with an EU Blue Card?

Yes, but the process is different depending on how long you’ve had the card. If it’s less than 2 years, the rules are stricter. After 2 years, it’s easier to change employers.

11. Do I need to know Polish to get a long-term EU resident permit?

Yes, you must show proof that you know the Polish language. The accepted documents are listed in the Foreigners’ Law.
